            The applicant has moved Civil Revision against the order dated 13.10.2003 passed in Civil Appeal No.29 of 2002, whereby the order allowing an application under Order 7 rule 11 CPC in F.C. Suit No.391/2000 was set aside and the matter was remanded back to the trial Court with the direction to record evidence of both the parties and decide the matte in accordance with law.

            Today Mr. Sundardas, Advocate holding brief for Mr. Abdul Hai Khan Pathan, Advocate filed a statement. Along with the same a copy of the order dated 30.11.2006 is attached which shows that the suit in the trial Court has already been withdrawn with a permission to file afresh. On seeing the copy of the order, the learned counsel for the applicant does not want to press this Civil Revision, which is dismissed as not pressed along with listed applications.
