This petition has been filed with the prayer that the appointment of the Petitioners, who applied for the post of Naib Qasid in BPS-02, be declared as legal and lawful and directions may be issued to the Respondents for paying them their salaries and other emoluments as required under the law, after the date of their joining the service and onwards.

Briefly stated facts as they appear from the record are that in the month of February, 2008 some posts of Naib Qasid, Chowkidar and Sanitary Workers lying vacant in the Office of the District Public Prosecutor (D.P.P) were advertised in daily “KAWISH” dated 13-02-2008 by the Respondent No.3. The Petitioners moved applications for the post of Naib Qasid along with 236 other candidates. A committee headed by Respondent No.5 along with two other members was constituted which held the interviews. After the said interviews of the Petitioners they were found eligible for the post of Naib Qasid on 15-02-2008 and on the recommendation of the said selection committee the Petitioners were issued appointment letters dated 16-02-2008 in BPS-02 on probation basis for a period of two years. Other codal formalities were also fulfilled and fitness certificate from Civil Surgeon, Civil Hospital Badin were also issued to the Petitioners, who on submission of such certificates were allowed to join their duties but were not issued posting orders.
3. That the Petitioners continued attending their offices till date but no salary has been paid to them since the date they joined their duties. Being aggrieved with the above action of the Respondents, the present petition has been filed.

Mr. Abdul Hafeez Memon, learned counsel appearing on behalf of the Petitioners has contended that the Petitioners are performing their duties diligently and honestly but they have been deprived of their salaries without any rhyme and reason. As per the learned counsel their services have neither been terminated nor they are placed under suspension. No reason has been assigned by the Respondents for not giving their monthly emoluments, which is against the norms of the law as provided under the law. As per the learned counsel, the Petitioners are poor fellows, whose families are dependent upon their monthly emoluments, which has been denied by the Respondents. He, therefore, submits that the Respondents be directed to release the monthly salaries of the Petitioners from the date of their joining and onwards forthwith declaring the Petitioners’ appointment as lawful.

The learned Additional Advocate General Sindh (AAG), on the other hand, has filed comments on behalf of the Respondents in which most of the averments made in the petition were admitted, however, it was contended by the learned Additional Advocate General that the appointment of the Petitioners was made by a committee, which was not competent to appoint. The learned AAG further submitted that as the very appointment of the Petitioners was irregular hence they were not given their salaries and the other emoluments. On a question posed to the learned Additional Advocate General by the Court that if the committee was incompetent then why offer letters were issued, and why the Petitioners were directed to get fitness certificates from Civil Surgeon and or why they were allowed to join their jobs and how are they continuing till date. No plausible explanation was offered by the learned AAG except repeating the aforementioned contention.
6. We have heard the learned counsel of the Petitioners, the learned Additional Advocate General and have also perused the record. In our view, the D.P.P. who was then in charge, was authorized to make appointments. The appointments have duly been made by the authorized authority and nothing wrong was found in the record. The person in charge making the appointment was competent to make such appointments and the submission made in this regard by the learned Additional Advocate General was devoid of substance. Moreover, letters of appointment were duly issued to the Petitioners for joining after fulfilling all the codal/legal formalities hence at this belated stage, it could not be said that the Petitioners appointment was irregular who joined and are attending their office till date but have not been issued posting orders. We have further asked from the learned AAG as to whether any action has been taken by the department against the Incharge D.P.P. who is said to have unauthorizedly and or irregularly appointed the Petitioners but he could not give any satisfactory reply in this regard.
7. It would not be out of place to mention that under similar circumstances in the case of “Muhammad Akhtar Shirani and others v. Punjab Text Book Board and others” reported as 2004 SCMR 1077, the Honourable Supreme Court of Pakistan has observed as under:-
“It may be observed that for such reason beneficiary cannot be blamed alone because primarily the authority who had actually mis-exercised his powers, for the reasons known to it, is bound to be held responsible for the same, instead of penalizing the petty employees like Chowkidar, Naib-Qasid, junior clerks etc. who have to earn livelihood to support their families and if after having served for a long period they are removed from service discriminately, such action would not promote the cause of action and it would give rise to a number of problems to them. In this regard at a number of occasions, it has been held by this Court that instead of removing the employees from service, action should have been taken against the authority who had mis-exercised its powers.”

In view of the aforesaid dictum of the Honourable Supreme Court, we are of the view that once the Petitioners after issuance of the offer/appointment letters have joined their duties they can not be refused disbursement of their salaries/emoluments interalia, on the ground that their appointments were irregular under the law. We, therefore, allow this petition declaring that the Petitioners were lawfully appointed against the respective posts and are entitled to the salaries from the date of their joining which should immediately be disbursed to them. We have already noticed that the Petitioners are attending the office after they joined be immediately issued posting orders without further delay.
9. Above are the reasons of our short order dated 02-12-2010, passed in the above proceedings for allowing the petition.
