Mr. Gianchand Keswani for the petitioner.

The petitioner was working as Clerk in General Post Office at Naushahro Feroze. He was dismissed from service on the allegation of misappropriation of Rs. 4,52,972/-. After failing in getting reinstatement in the departmental proceedings, he filed Appeal before the Federal Service Tribunal, Islamabad, which Appeal was dismissed, vide order dated 08-07-2006 on the ground that it was barred by time. After dismissal of the Appeal, the petitioner challenged the same in the Petition before this Court, which was withdrawn and again the present Petition was filed on 19-02-2010.

The petitioner, being in service with General Post Office, had the remedy before the Supreme Court in terms of Article 212 of the Constitution but he has failed to avail such remedy. The said Article of the Constitution bars the jurisdiction of this Court to interfere with the decision of the Federal Service Tribunal.

This Petition, being not maintainable before this Court, is dismissed.
