            With the consent of the parties, the impugned order dated 24.2.2010 passed by learned Vth Additional District Judge Hyderabad in FRA No. 158 of 2009 is set aside and the matter is remanded back to the Sessions Court with direction to decide afresh on merits needless to say that after hearing the parties. This exercise shall be completed within one month.
