                        It is stated that out of 23 petitioners, 12 petitioners have not crossed threshold of 03 years’ service when the order dated 21-10-2009 was passed and only 11 petitioners were eligible for being considered for regularization. Out of 11, only services of one have been regularized

                        Let the interviews of remaining 10 petitioners be taken for the purpose of regularization and overage factor shall not be taken into consideration if any of them was within the age limit when he was initially taken in temporary service. In the interview, fitness to work as Muawin shall only be the criteria for consideration. Let this exercise be completed within 06 weeks and, thereafter, necessary orders of appointment, in terms of order of this Court dated 21-10-2009, shall be passed. The relevant portion of which reads as under:-

“We therefore dispose of this petition in the terms that till the operation of this directions is suspended by the competent authority, all those persons who have gained three years experience and have been serving in class-IV of the staff will have the opportunity for their services to be regularized subject to availability of vacancies and subject to the condition that they shall clear their interview.”

                        These applications are disposed of accordingly.
