Per learned counsel, the applicants are innocent and they have nothing to do with the alleged offence; interim pre-arrest bail granted to co-accused Dr. Diyal was confirmed by this Court vide order dated 12.7.2010; offence is maximum punishable upto 03 years hence does not fall within the prohibitory clause of Section 497 Cr.P.C. It is lastly contended that applicants have been made escaped good by the police in order to show their so called efficiency. In support of his contentions, learned counsel has placed on record the photo copy of order dated 12.7.2010.

Learned D.P.G for the State did not oppose the confirmation of bail.

Heard learned counsel for the parties and perused the record.

Admittedly, interim pre-arrest bail granted to co-accused Dr. Diyal has been confirmed by this Court vide order dated 12.7.2010. The applicants have been charged with the offence which is punishable upto 03 years and does not fall within the prohibitory clause of Section 497 Cr.P.C. Moreover, none amongst the PWs have claimed to be eye witness of the incident when the applicants allegedly slaughtered a dead animal.

For the foregoing reasons and no objection raised by learned State Court, interim pre-arrest bail earlier granted to the applicants is hereby confirmed on same terms and conditions.

The Criminal Bail Application stands disposed of.
