                        Comments filed by the respondents are taken on record.

                        The petitioners claim that they were working on meager salary as menial staff of the College and were being paid salaries from College management fund. It is stated that in the year 2003, Principal of the College recommended their names for appointment as permanent staff but such recommendations were not considered and fresh applications were invited and other persons were appointed. It is the case of petitioners that the other persons, who were appointed i.e. respondents Nos. 6 to 17, were not residents of the locality and, secondly, it was also argued that since they have also applied, they should have been given preference as they were already working and duly recommended by the Principal of the College.

                          When asked by this Court as to whether any application pursuant to the advertisement has been made by the petitioners, counsel for the petitioners was unable to point this out from the record.

                        On the other hand, counsel for the respondents Nos. 6 to 17 has placed on record the domicile certificates of the respondents Nos. 6 to 17 which show that they are residents of the same area.    

                        In view of this background, we cannot declare the appointment of respondents Nos. 6 to 17 as illegal. However, we are of the view that the petitioners, who have served the College for a number of years, therefore, whenever any vacancy occurs, the same shall be intimated in writing to the petitioners so that they may be able to apply for the same. They shall, then, be considered for appointment in accordance with the prescribed rules and regulations.

                        With these directions, this petition along with the listed application stands disposed of.
