Mr. Waqar Ahmed Bhurgri files power on behalf of Respondent No.1 which is taken on record.

The alleged detenue Mst. Shahzadi states that she is not willing to live with Respondent No.1 due to his cruel behaviour. On 14.10.2010 when she was produced alongwith her minor children, she desired to live with her mother therefore, she was allowed to go to her mother. Today she took the same plea and stated that she cannot live with Respondent No.1.

Since the detenue Mst. Shahzadi is sui-juris, she cannot be compelled to live with Respondent No.1 against her wishes therefore, she is set at liberty to live with her mother.

With the above observations, this Criminal Miscellaneous Application stands disposed of. However, Mst. Shahzadi or her parents shall not be harassed or intimidated in any manner.
