I do hereby state on Solemn Affirmation as under:-

My name is:-                Shrimati Siani.

Daughter of:-                Khamiso.

Wife of:-                       Krishan Bheel.

Aged abodut:-              20 years.

Occupation:-                Household.

Resident of:-                 Village Yaseen Punjabi, Taluka Jhudo,

                                    District Mirpurkhas.

EXAMINATION-IN-CHIEF.

TO COURT:-

            Khamiso present in Court is my father. Chanio and Gomindo are my uncles. About two years back I being a sui-juris, was married to applicant Malook. I remained with Malook for about 09 months. As Malook was a man of questionable character and used to behave in very cruel manner, therefore, I left his house and went to my father’s house. Subsequently, I filed a Family Suit No.44/2009 before the Civil Judge/Family Judge, Dighri against Malook for dissolution of marriage/judicial separation. On 31.3.2010, the said suit was decreed in my favour. After obtaining the decree, I contracted marriage to Krishan s/o Kauro Bheel. I am living with Krishan happily. I have not been abducted or detained by any one. Today I have been produced in Court by my father. I want to live with my husband Krishan.

The statement of detenue Shrimati Siani has been recorded in which she has categorically stated that about two years back, she being a sui-juris was married to applicant Malook and she remained with him for about 09 months but due to his cruel behaviour she left his house and went to her parents house. Later on she filed a Family Suit No.44/2009 before the Civil Judge/Family Judge, Dighri for dissolution of marriage/judicial separation. On 31.3.2010 the above suit was decreed in her favour and she subsequently contracted marriage with Krishan s/o Kauro Bheel. She further stated that neither she has been abducted nor detained by any one and she is living happily with her husband Krishan in his house.

Since, Shrimati Siani is a sui-juris and she has clearly stated that she is wedded wife of Krishan and living happily with him and that she has not been abducted or detained by any one, in view of above, she is se at liberty to go with her husband Krishan.

The Criminal Miscellaneous Application stands disposed of in the above terms alongwith listed application.
