In
this matter the petitioner prayed that that the official respondents may be
directed not to harass the petitioner, her husband and relatives in any manner
whatsoever in nature with a further prayer that the respondent No.1 may be
directed to register the FIR of the petitioner against the private respondents.
Learned
A.A.G. waives notice of this petition, copy has been supplied to him and he
undertakes that the proper protection will be provided to the petitioner.
The learned counsel for the
petitioner further prays that the respondent No.2, who is the SHO of P.S.Ghotki may be directed to lodge the complaint of the
petitioner as the alleged offence has been committed in the limits of P.S. Ghotki. So far as the directions to the respondents No.2 is
concerned. The learned A.A.G. argued that since the official respondents will
provide the protection to the petitioner, she may go and lodge FIR at P.S.Ghotki, and in case of refusal, she may apply under
Section 22-A Cr.P.C. to which the learned counsel for the petitioner submits
that the life of the petitioner is at stake, as the respondents No.3 to 17 have
already declared her as ‘Karo Kari’, therefore, much
time will be lapsed by applying the Sessions Judge u/s 22-A & 22-B Cr.P.C.,
therefore, in the interest of justice, respondent No.2 may be directed to
record the statement of petitioner and if any cognizable case is made out lodge
FIR against the private respondents.
The request of the learned counsel
for the petitioner seems to be reasonable. Let the learned A.A.G. is directed
to provide due protection to the petitioner as and when she will approach to
the office to learned A.A.G. and after providing necessary protection, she will
go to Ghotki for lodging of FIR and if on the basis
of her statement, any cognizable case is made out, the respondent No.2 will
register FIR.
The petition alongwith listed
applications stands disposed of in the above terms.
