Through this S.M.A the petitioner Faisal Abdulla, has applied for grant of Succession Certificate in respect of debt and securities of the deceased Arshad Abdulla s/o late Abdulla Abdul Razzak, who died on 25.10.2009 at Germany.
Upon a perusal of S.M.A, it appears that at the time of his death, deceased Arshad Abdulla left behind Mst. Zahida Arshad (widow), Faisal Abdulla (son), Asna Abdulla (Daughter) and Sana Abdulla (daughter) as his surviving legal heirs. All the said legal heirs of the deceased are major and they have filed their respective Affidavits of No Objection to the grant of Succession Certificate in favour of the Petitioner.
Today all the legal heirs including the petitioner are present in Court who categorically stated that they have no objection if Succession Certificate is granted in favour of the petitioner. Witnesses namely Asad Abdulla and Ayaz Abdulla are also present in Court and they identified the petitioner and other legal heirs.
Since all the formalities including the publication in Daily Jang Karachi in its issue of 17.04.2010 have been fulfilled but none has come forward to raise any objection or whatsoever, therefore this Application is allowed and the Nazir of this Court is directed to issue Succession Certificate to the Petitioner in respect of the debt, securities, shares and other assets left by the deceased Arshad Abdulla in accordance with the rules.
The S.M.A. stands disposed off.
