Through this S.M.A the petitioner Muhammad Younus has prayed for grant of Letter of Administration in respect of immovable / movable properties left by deceased Muhammad Yaseen s/o Muhammad Deen, who died on 13.02.2010 at Karachi.
Upon a perusal of para No.2 of the S.M.A, it appears that at the time of his death, deceased Muhammad Yaseen left behind the following legal heirs:-

Notices were issued to all the legal heirs of the deceased through courier service and registered post A/D. All the legal heirs of the deceased are major and they have filed their affidavits of No Objection to the grant of Succession Certificate in favour of the Petitioner.
Today all the legal heirs of deceased Muhammad Yaseen alongwith the petitioner are present in Court who categorically stated that they have no objection if Letter of Administration is granted in favour of the petitioner. Four witness namely Muhammad Iqbal, Shahzad Ahmed Mughal, Muhammad Mansha and Abdul Shakoor alongwith their original CNICs are also present in Court, they are relatives as well as neighbours of the petitioner. They stated that at the time of death, deceased Muhammad Yaseen has left behind the above mentioned legal heirs as stated in para No.2 of the petition and they also identified the petitioner as well as other legal heirs.
Since all the formalities including the publication in Daily “Jang” Karachi in its issue dated 15.05.2010 have been fulfilled but none has come forward to raise any objection, therefore this Application is allowed and the Nazir of this Court is directed to issue Letter of Administration to the Petitioner in respect of the immovable and movable properties left by deceased Muhammad Yaseen in accordance with the rules.
The S.M.A. stands disposed off.
