                        Comments have been filed by the learned Additional A.G, copy of which has been supplied to the Counsel for the Petitioner.

                        The Assistant District Officer is not competent either to initiate the departmental proceedings or to pass any order which is impugned in these proceedings. The competent authority is the E.D.O. The order dated 19.8.2009 having been passed by the Assistant District Officer is set aside. The Petitioner shall be restored to his original position and it will be open to the competent authority to initiate the departmental proceedings against the Petitioner.

                        The petition stands disposed of in the above terms.
