Appellants
Ahsan alias
Raju and Haji alais Ali Murtaza were acquitted
in terms of judgment dated 23.02.2026 by way of compromise with the direction
that they would deposit Diyat
amount Rs.4,739,823/- in 60 monthly installments. Along
with urgent application, learned counsel for appellants has filed application
under Section 561-A, Cr.PC for correction in the
judgment dated 23.02.2026 on the ground that mistakenly it has been mentioned
in the judgment that the appellants would deposit 60 monthly installments of
Rs.79,000/- each.
Learned counsel for appellants submits that Diyat amount of Rs.4,739,823/- was calculated against the appellants to
deposit the said amount in 60 monthly installments of Rs.79,000/-, which can be
corrected otherwise the said amount of Rs.4,739,823 would be doubled.
Learned
Additional Prosecutor General Sindh, present in Court in some other cases,
waives notice and after having gone through the case file has recorded no
objection.
In
view of above, listed application is allowed. The office is directed to make
correction in the judgment dated 23.02.2026 to the extent of word “each” in line No.11, of Para 6 with red
ink.
