Applicants
are accused in Complaint No.19/2002 and they have impugned the order dated
24.01.2006, passed by learned Presiding Officer, Bank Court-II, Karachi,
whereby their application under Section 265-K, Cr.PC
was dismissed. Instant criminal miscellaneous application is pending since
16.02.2006, without any progress. Today, Mr. Muhammad Khosa,
counsel for applicant, once again seeks time for preparation. Applicants seek
premature acquittal in a complaint case. Counsel for applicant is unaware about
pendency of aforesaid Complaint before learned trial Court, which reflects that
applicants and their counsel have lost their interest in pursuing this case. Therefore,
instant criminal miscellaneous application is dismissed along with all the
pending applications. However, if the case is still pending they may repeat the
same application before learned trial Court on fresh grounds.
