Jameel Mendhro, Jamshed Mendhro, Umar and Ali
Muhammad alias Ali seek pre-arrest bail in FIR No.233/2025, registered at P.S. Dhabeji, District Thatta for
offence under Sections 324, 337-F(i), 504, 34 PPC, after rejection of their
bail plea by learned Additional Sessions Judge-I/M.C.T.C., Thatta
vide order dated 16.01.2026.
At the
very outset, learned counsel for applicants submits that the alleged offence is
compoundable, the parties have settled their dispute outside the Court and they
will file proper application before the concerned Court. However, he submits
that complainant has furnished affidavit of no objection. Mr. Ahmed Ali,
advocate, files Vakalatnama on behalf of complainant along with affidavit of no
objection on pre-arrest bail to the applicants. He submits that the parties
have settled their dispute outside the Court therefore the complainant has
recorded no objection. Learned A.P.G. has recorded no objection for grant of
bail.
Heard
learned counsel for applicants, learned A.P.G., learned counsel for
complainant, and perused the material available on record.
The
alleged offence is compoundable; all the Sections applied in the FIR are bailable except Section 324, PPC. During pendency of
instant criminal bail application, the parties have settled their dispute
outside the Court and the complainant has recorded no objection for
confirmation of their pre-arrest bail. In view of above, instant criminal bail
application is allowed and the interim pre-arrest
bail granted to the applicants/accused is confirmed on the same terms and
conditions. However, they are directed to file proper application before the
concerned Court, in accordance with law.
Instant criminal bail application is
disposed of in the above terms.
