            Applicant Munir Ahmed seeks pre-arrest bail in FIR No.54/2025 of P.S. Mochko for offence under Section 320, 279, 427 PPC, after rejection of his bail plea by learned Additional Sessions Judge-X, Karachi West vide order dated 1.02.2025.

 

            Briefly the facts as stated in the aforesaid FIR are that a white coloured bus bearing Registration No.LXP-3272, driven by an unknown driver, was being driven rashly and negligently, resulting in a road accident, which caused death of Ayesha wife of Faqeer Muhammad (aged about 24 years), hence the subject FIR.

 

            Learned counsel for applicant submits that main section applied in FIR is bailable and during investigation IO found the applicant innocent, released him by placing his name in Column No.2 of Challan and submitted the summary before learned concerned Magistrate in “A” class but still learned Magistrate has not passed any order on it.

 

            Learned A.P.G. opposed for grant of bail on the ground that he is not satisfied with the investigation.

 

            Heard learned counsel for applicant, learned A.P.G. and perused the material available on record.

 

            Applicant is not nominated in the FIR and the IO has found him innocent and released him by placing his name in Column No.2 of the challan and placed summary in “A” class before learned concerned Magistrate. Since the IO has found the applicant as innocent, as such, his case requires further inquiry in terms of Section 427(2), Cr.PC, therefore, interim pre-arrest bail granted to the applicant/accused is confirmed on the same terms and conditions.

 

            Instant criminal bail application is disposed of in the above terms.
