4. Applicant/accused
Haji Muhammad Ashraf son of Qamir-ur-Din Malik, who is
presently in Dubai, has filed instant criminal bail application through his
attorney/real brother Muhammad Akran son of Qamir-ur-Din Malik, seeking protective-cum-transitory
bail in FIR No.648/2022, registered at P.S. Darakhshan,
Karachi for offence under Sections 489-F, PPC.
Learned
counsel for applicant submits that applicant was unaware about registration of above
FIR and is not a willful absconder; that aforesaid FIR was registered at the
time when applicant was abroad; that he is innocent and has been falsely
involved in this case for mala fide intentions and ulterior motives; that
applicant is a law abiding citizen and intends to surrender before the
concerned Court but he apprehends his arrest at the hands of police in order to
humiliate and disgrace, hence he needs protection in order to enable him to
appear before the concerned Court.
Without touching the merits of the case, protective-cum-transitory bail is
granted to applicant above named in the aforesaid FIR, for a period of ten (10) days from today, subject to
his furnishing solvent surety in the sum of Rs.100,000/- (Rupees One Hundred Thousand)
and P.R bond in the like amount to the satisfaction of the Nazir of this Court.
Applicant is directed to surrender before the concerned Court in the aforesaid
period and join the trial forthwith. This order shall cease to have its effect
after expiry of ten days from today
or whenever the applicant surrenders before the concerned Court, which one
occurs earlier. The applicant is cautioned that this concession of protective
bail will not be extended for any reason whatsoever and if he fails to
surrender himself before the relevant Court during validity of this protective
bail, his bail bond shall stand forfeited.
Instant
Criminal Bail Application stands disposed of in the foregoing terms.
