            Applicant Nasrullah Khan seeks interim pre-arrest bail in FIR No.05/2026, registered at P.S. Ittehad Town for offence under section 320, PPC, after dismissal of his bail plea by learned Additional Sessions Judge-X, West Karachi.

            It is alleged in FIR that nephew of complainant, namely Burhan son of Muhammad Tariq, aged about 5 years, met with road accident by Bus No.PF-2423, who was brought to Civil Hospital where he died, hence the subject FIR.

 

            Learned counsel for applicant submits that alleged offence is bailable and legal heirs of deceased boy Burhan have extended no objection for grant of bail on the basis of compromise arrived at between the parties.

 

            Learned A.P.G., assisted by complainant in person, has recorded no objection on the ground that alleged offence is bailable and legal heirs of deceased boy, including complainant, have recorded no objection for grant of bail.

 

            Heard learned counsel for applicant, learned A.P.G., complainant and perused the material available on record.

 

            Admittedly, alleged offence is compoundable and bailable and the parties have settled their dispute out the Court. Complainant, who is uncle as well as parents of deceased boy Burhan have extended no objection for grant of bail to the applicant on the basis of compromise. In view of such position, interim pre-arrest bail granted to applicant above named vide order dated 28.01.2026 is confirmed on the same terms and conditions. Applicant is directed to join the trial forthwith.

 

The observations made herein above are tentative in nature, the same would not prejudice the case of either party at trial.

 

            The instant criminal bail application is accordingly disposed of.
