Muhammad Chutal Arijo, seek
protective bail in FIR No.55/2026, registered at P.S. “A” Section, Tando Allahyar for offence under
Sections 380, 409, 420, 269, 270, 273, PPC.
Learned
counsel for applicants submits that applicant Niaz
Ahmed Arijo is District Food Controller whereas
applicant Shahbaz Khan is Food Supervisor in Food
Department, Government of Sindh and there is allegation against them that they
have misappropriated wheat from the godown; that they
are law abiding citizens and intend to surrender before the concerned Court but
they apprehend their arrest at the hands of police in order to humiliate and
disgrace, hence they need protection in order to enable them to appear before
the concerned Court.
Without touching the merits of the case, protective bail is granted to applicants/accused
above named, for a period of seven (7)
days from today, subject to their furnishing solvent surety in the sum of Rs.50,000/- (Rupees Fifty Thousand) each and P.R bond in the like amount to
the satisfaction of the Nazir of this Court. Applicant is directed to surrender
before the concerned Court in the aforesaid period and join the trial
forthwith. This order shall cease to have its effect after expiry of seven days from today or whenever the
applicant surrenders before the concerned Court, which one occurs earlier. The
applicant is cautioned that this concession of protective bail will not be
extended for any reason whatsoever and if he fails to surrender himself before
the relevant Court during validity of this protective bail, his bail bond shall
stand forfeited.
Instant
Criminal Bail Application stands disposed of in the foregoing terms.
