Applicant
Sohail Ahmed son of Nazir Ahmed Jamali
seeks post arrest bail in FIR No.325/2025, registered at P.S. Defence for
offence under Section 376, PPC.
Record
reflects that counsel for applicant remained absent on 27.11.2025, 19.12.2025,
19.01.2026 and today counsel for applicant once again is called absent.
Brief
facts of the prosecution case are that applicant is stepfather of alleged
victim, namely, Miss Kiran, aged about 16 years, who
disclosed to her mother that her stepfather has committed rape with her and
issued threats that if she disclosed such fact to anyone he will commit her
murder. Perusal of facts and grounds mentioned in memo of bail application
reveal that there is a delay of eight days in lodging of FIR and his case calls
for further inquiry on the ground that instant case is a false one; that there
is no criminal record of applicant and he will not tamper with the evidence.
Learned
A.P.G., assisted by learned counsel for complainant, opposed for grant of bail
on the ground that this is a heinous offence and allegedly applicant, who is
stepfather of the victim, has committed rape with her and issued threats of
dire consequences if she disclosed such fact to anyone.
From
perusal of record, it appears that applicant is stepfather of victim and he
committed rape and sodomy with her, which brings the case of applicant within
the ambit prohibitory clause of Section 497, Cr.PC.
No case for grant of bail is made out, therefore,
instant criminal bail application is dismissed with direction to the trial
Court to conclude the trial preferably within a period of three months. However,
the applicant would be at liberty to repeat his bail application before the
trial Court.
