Muhammad Rashid son of Muhammad Shafi seeks
pre-arrest bail in FIR No.312/2025, registered at P.S. Khawaja
Ajmer Nagri for offence under Sections 402, 406, PPC,
after rejection of his bail plea by learned Additional Sessions Judge-VI,
Karachi Central vide order dated 12.08.2025.
During
pendency of instant criminal bail application, parties have settled their
dispute out the Court and the complainant of this case has filed application
for compromise and has sworn such affidavit. Operative part of compromise
application is reproduced as under:
“(i) That, it is fact that with reference of
Applicant being Agent, the Complainant got purchased the Vehicle bearing
No.AZP-429 Toyotta Car through Muhammad Siddiq @ Malik who brought the Car at Showroom of Rashid
(Applicant) alongwith Original Complete File, and
before dealings, the Complainant inquired the Vehicle physically, via
documentary and through C.P.L.C. by making Call and Online. It is fact that at
that time the Vehicle were cleared and the dealing for sale and purchase were
finalized at Rs.17,55,000/- and the same were paid by the Complainant and
thereafter the peaceful possession of aforementioned Car were handed over to
the Complainant in presence of Rashid/Applicant.”
Complainant
is present and reiterated the facts mentioned in the compromise application
along with its supporting affidavit.
In
view of above, interim pre-arrest bail granted to the applicant/accused by this
Court vide order dated 21.08.2025 is confirmed on the same terms and conditions
on the basis of affidavit sworn by the complainant.
