O R D E R

Notice ordered on the last date of hearing in respect of respondent No.8 it is reported that the said respondent is an absconder in Crime No.130 of 2022 Police Station, Kumb u/s 302, 324, 148, 149, 114 PPC.

Learned counsels present after arguing the matter at length finally agreed that though the version thereof and the allegations made in the matter having been denied irrespective to the same the lodging of the FIR being based upon a occurrence of cognizable offence the impugned order be set-aside and it may further be ordered that the statement of the applicant be recorded and in case a cognizable offence is made out FIR be lodged u/s 154 Cr.P.C, however, in order to ensure that no inconvenience is caused to the parties alleged against without due course of law. It be further ordered that no arrest in the matter shall take place until and unless the Investigating Officer is having with him cognizable material as required in accordance with law. Ordered accordingly.

Matter stands disposed of in the above terms.
