Learned counsels in the matter on going through the impugned order agreed that in case demarcation of the applicants legally entitled area is made out the controversies in the matter are liable to be resolved. In this regard as participation of learned AAG was required as such called upon for assistances who was pleased to waive notice. Learned AAG concedes to the required demarcation provided the legal entitle of possession is available to the applicant, irrespective to the Mukhtiarkar’s report favouring the entitlement otherwise present. Accordingly, it is ordered that the Mukhtiarkar concerned and Survey Superintendent, Khairpur the concerned officials shall conduct the exercise to demarcate the legally entitled land of the applicant for which the required legal charges shall be paid by the applicant, said exercise shall be concluded within 30 days.

Matter stands disposed of in the above terms.
