Complainant present though requires attendance of the
counsel in the first date as multiple dates were acquired by further
entertainment was not found available and thereafter the matter was heard.
Learned counsel for the applicant after arguing the matter at some length
required the bail application to be disposed of by way of directions although
he contended that earlier one of the co-accused having filed bail application
No.S-61 of 2025 acquired directions of disposal within two months by order
dated 19.05.2025 the same has not been complied with. Learned Deputy Prosecutor
General however, relying upon the diary sheets of the learned trial Court
contending that the witnesses are in attendance in case before the learned
trial Court and it can be reasonably expected that the witnesses may be
examined at the earliest. Accordingly, this bail application is disposed of
directing the learned trial Court to ensure that the conclusion of the trial or
at least the Doctor in priority conducting the post mortem and the witnesses be
examined within a period of three months for conclusion of the trial and the
applicant may exercise the available options as available to him in accordance
with law.
Bail application stands disposed of in the above terms.
