Learned counsel for applicant files statement alongwith Photo copies of record provides copy thereof to learned Deputy Prosecutor General. Learned counsel for the applicant after arguing the same at some length finally concedes that in case directions are issued this bail application be disposed of as not pressed. The examination of witnesses especially the important and material witnesses is required in the first instance as subsequent to the remand of the matter in the earlier proceedings conducted on part of the other co-accused Denovo trial is to be conducted which is not proceedings as required. Learned Deputy Prosecutor General states that although the number of is about 11 perhaps 3 or 4 witnesses may be found material enough to be considered for any further conclusion on merits. Accordingly, learned trial Court is directed to make a sincere attempt to conclude the evidence of atleast the important and material witnesses within a period of three(03) months’. Applicant, however, is free to exercise his available options of seeking bail on the basis of available record in the present matter in accordance with law.

Bail application stands disposed of in the above terms.
