Mr. Muhammad Hamzo Buriro, Advocate files Vakalatnama on behalf of private respondent. Learned counsel for applicants and private respondents as well as learned Deputy Prosecutor General agree that the impugned order in the matter be set-aside and based upon the allegations and the requirement in the matter an order be passed for further investigation whereby the I.O, in the matter is to acquire report from the Mukhtiarkars concerning the fixation of boundary stones compared to what was already present in compliance to the earlier order passed in C.P.No.D-886 of 2023 and thereafter submit further report before the concerned Magistrate who shall re-consider the taking of cognizance in view of the material including the said report within a period of 30 days.

With the above directions present Crl. Misc. Application is disposed of accordingly.
