petitioner which is taken on record.
1. Office objections are deferred.
2. Exemption application is granted subject to all just
exceptions.
3. Through instant constitution petition, petitioner seeks inter alia direction to respondents No.1
to 4 to arrest the absconding accused Tahir Hussain in crime No.162/2015
registered at Police Station, Mirpur Mathelo and to produce him before the
Court of law.
Learned counsel for petitioner contends that on 19.11.2015
accused Tahir/respondent No.5 on the instigation of co-accused Saleemullah
fired upon Anwar Ali, the brother of the petitioner, which hit him on right
side of neck consequently, aforesaid FIR was registered. He further contends
that after submission of challan, on 20.11.2021, respondent No.5 was declared
as proclaimed offender by the trial Court and despite issuance of NBW against
him police officials/respondents No.1 to 4 failed to arrest him hence, this
petition has been maintained.
It is an admitted position that the respondent No.5 is a
proclaimed offender in aforesaid crime/FIR for that perpetual Non-Bailable
Warrant has been issued by the trial court. It is even not in the knowledge of
the petitioner as to where the respondent No.5 is hidden to avoid his arrest.
In view of perpetual NBW he is likely to be arrested as and when he surfaces.
Even, if the whereabouts of respondent No.5 comes in the knowledge of
petitioner he may approach concerned police official for his arrest. This
petition is however, being devoid of any merit is dismissed in limine.

this petition, the petitioner has prayed as under;
a). That this Honourable Court may be pleased to declare
the letter dated 09.06.2020 as null void, ab initio.
b). That this Honourable Court may be pleased to suspend
the operation of impugned letter dated 09.06.2020 issued by the Food Department
as per wish of the NAB authorities
illegal rate till disposal of this petition in hand.
c). That this Honourable Court may be pleased to direct the
respondents to determine the liability
as the petitioner wants to enter into Plea Bargain (P.B) as per Issue
Rate of Sindh Government i.e. 3450 Rupees/100 Bags instead of 4120.59/100 Bag
as per NAB Ordinance, 1999.
d). To grant any other equitable relief deemed fit and
proper in the light of above facts and circumstances.
Since, the
reference No.22 of 2020 has been filed against the petitioner which is pending
adjudication before the Accountability Court at Sukkur which being competent
has to decide the application as well as resolved the grievance of the
petitioner therefore, in view of above instant petition seems to be immature
and is not maintainable. Accordingly, instant petition is dismissed along with
listed applications.
