2. As to the office objection learned counsel states that on
account of urgency said objection is overruled. Ordered accordingly.
3. Granted, subject to all just exceptions.
4. Through instant application, applicant Raza
Ali alias Raza Muhammad son of Umed Ali seeks protective bail in Crime
No.08/2012 Police Station, Bagerji under Sections 462-D, 462-E, 379 PPC.
It is, inter alia, contended
that applicant is
innocent and has
falsely been involved in this case by the complainant with malafide intention and ulterior motives.
It is further contended that as
soon as applicant came to know he tried to surrender himself before the concerned Court
for pre-arrest bail but
applicant has grave
apprehension of his being arrest
before reaching the same at the hands of concerned police hence, he has approached this Court for
grant of protective bail.
Be that as it may, without touching merits and
demerits of the case and in order to enable applicant to appear before
concerned Court, he is granted protective
bail for a period of 05(Five) days commencing from today, subject to furnishing his solvent surety in
the sum of Rs.20,000/- (Rupees
Twenty thousand) and PR bond in the like amount to the satisfaction of
Additional Registrar of this Court. In the meanwhile operation of NBWs, if any,
issued against the applicant is suspended for the aforesaid period. This order
shall cease to have its effect on expiry of said period or on appearance of
applicant before concerned Court, whichever is earlier. In case, applicant fails
to surrender before the learned trial Court within stipulated period, his bail
bond shall stand forfeited.
Bail application stands disposed of in the above terms.
