          The learned Counsel for Petitioner submits that he would be satisfied if the present petition is dismissed as withdrawn and Petitioner may be allowed either to file revision application before the E.D.O (Revenue) or a suit before a Court having jurisdiction in the matter.

          We would therefore by consent of the Counsel for Respondents dismiss this petition as withdrawn with permission to the Petitioner to avail his remedy either by way of revision or through filing suit within fifteen days (15) and the delay, if any, in filing such proceedings is condoned.

          The listed application is also disposed of.
