1. Urgency is granted.
2. Exemption is granted subject to all exceptions.
3. Applicant Muhammad Shoaib son of Khadim Hussain, is present along with his Counsel to seek protective bail to enable him to appear before the Trial Court for seeking appropriate relief. Learned counsel for applicant submits that applicant is innocent and has been falsely implicated by complainant in Crime No.137/2023 of PS KIA, Karachi, under Section 9(i)3(c) of the CNS (Amendment) Act, 2022 and police has shaken hands with complainant party and it is made difficult for applicant to approach the concerned Court for getting appropriate relief as such he has appeared before this Court for seeking protective bail.
Without commenting on the merits / demerits of the case, applicant is admitted to protective bail for a period of five (05) days from today to enable him to seek remedy as provided under the law before the relevant Court subject to furnishing solvent surety in the sum of Rs.40,000/- (Rupees forty thousand only) and PR bond in the like amount to the satisfaction of Nazir of this Court. This order shall cease to have its effect on 05.09.2025 or on approaching the applicant before the relevant Court whichever is earlier. The applicant is cautioned that this concession of protective bail will not be extended for any reason whatsoever and if the applicant fails to surrender before the relevant Court during validity of this protective bail, the bail bond shall stand forfeited.
The criminal bail application is disposed of in the foregoing terms.
