The applicant had sent an application from jail, in which he prayed to transfer him from District Jail Dadu to Sub-Jail Mehar. On receipt of this application, this Court converted it into a bail application on 22.12.2009 and called the comments. The Additional Sessions Judge Mehar has submitted his comments on 17.2.2010, in which he stated in para-5 that the applicant has already been granted bail in Sessions Case No.268 of 2006, vide order dated 2nd October, 2009, but the applicant has failed to furnish required surety. On query, the applicant informs that he was granted bail subject to furnishing surety of Rs.100,000/- but due to his limited means and sources he failed to furnish the surety in the like amount. However, he requested to this Court for reduction of the surety amount from Rs.100,000/- to Rs.50,000/-.
The learned D.P.G has no objection if the amount of surety is reduced to Rs.50,000/-.
In view of the above, the request of the applicant is allowed. The surety amount of Rs.100,000/-is reduced to Rs.50,000/-. The trial Court is directed to accept the solvent surety in the sum of Rs.50,000/- with P.R Bond in the lime amount.
Bail application disposed of accordingly.
Let record and proceedings be sent back immediately.
