            Along with urgent application, application for return of surety is moved by applicant/surety. It appears that protective bail was granted to applicant Taj Muhammad son of Long Khan by this Court vide order dated 03.06.2019, subject to furnishing solvent surety in the sum of Rs.100,000/- and P.R. bond in the like amount to the satisfaction of the Nazir of this Court. As per endorsement of Nazir, one Manzoor Ali son of Haji Mehroo Khan furnished surety for applicant by way of depositing solvency certificate dated 30.05.2019, in respect of Agricultural Land, Deh Kapori Survey No.74/4 and others (18-34) acres.

 

            Counsel for applicant/surety submits that the applicant surrendered before the trial Court, faced trial and was acquitted of the charge vide judgment dated 21.02.2020. Certified copy of judgment dated 21.02.2020 is placed on record. Learned D.P.G. present in Court in some other cases waives notice and after having gone through the case file and aforesaid judgment of the trial Court has recorded no objection for return of surety.

 

            In the view of above, surety is no more required. Application for return of surety is allowed. Office is directed to return the surety to the applicant/surety upon proper verification and identification, as per rules.
