Hameero son of Mamoon Charan seeks pre-arrest bail in FIR No.03/2025, registered
at P.S. Sujawal for offence under section 489-F, PPC,
after rejection of his bail plea by learned 1st Additional Sessions
Judge, Sujawal vide order dated 20.01.2025.
Learned
counsel for applicant submits that during pendency of instant criminal bail application
parties have settled their dispute outside the Court and learned trial Court
has acquitted the applicant of the charge vide order dated 24.04.2025 by way of
compromise. Learned counsel for applicant by way of his statement has placed
certified copy of order dated 24.04.2025 passed by learned Civil Judge &
Judicial Magistrate, Sujawal, it is taken on record.
Learned counsel for complainant has also filed statement along with detail of cheques which were issued by the applicant/accused in lieu
of compromise arrived at between the parties.
In
view of above, instant criminal bail application has become infructuous, it is
accordingly dismissed. So far as the surety furnished in the instant criminal
bail application is concerned, it is no more required. Nazir is directed to
return the surety, however, after proper verification and identification, as
per rules.
