Applicant/accused Shahnawaz son of Iftkhar Hussain seeks post arrest bail in FIR No.01/2025,
registered at PS ANF Clifton, Karachi for offence under Section 7, 9(2), 9, 14,
15 of CNS Act, 1997, after rejection of his bail plea by learned Judge, Special
Court-II (CNS), Karachi vide order dated 21.03.2025.
Learned counsel for applicant at the
very outset submits that bail application of applicant was dismissed on
21.03.2025 and on the same day IO submitted challan.
Neither he has gone through report under Section 173, Cr.PC submitted by IO nor learned trial Court gone through
it before passing of order whereby his bail plea was declined. Perusal of
report under Section 173, Cr.PC shows there is only a
single transaction, which does not belong to applicant. However, after arguing
the bail application at some length, he does not press the same and intends to
move bail application before leaned trial Court on the basis of final report
submitted by IO under Section 173, Cr.PC. Learned
Special Prosecutor ANF has recorded his no objection on such proposal.
This Court issued show cause notice
to the Regional Director for non-compliance
of Court’s orders. Today, IO/representative of Regional Director, ANF has
furnished reply to the show cause notice, which is found satisfactory and the
same is hereby vacated, however, with note of caution that Regional Director,
ANF shall remain careful in future.
In view of above, instant criminal
bail application is disposed of with direction to the learned trial Court to
decide the bail application of present applicant in view of the report
submitted by the IO under Section 173, Cr.PC.
