Asadullah Mirani son
of Lutufullah seeks protective bail in FIR No.850/2024,
registered at P.S. Gulistan-e-Johar,
Karachi, for offence under Sections 23(1)(a) of the
Sindh Arms Act, 2013. Learned counsel for applicant submits that applicant is
innocent and he has been falsely implicated in this case for mala fide
intentions and ulterior motives; that applicant was granted bail by learned
Court of Sessions concerned but due to some unavoidable circumstances he jumped
the bail and now he intends to surrender before learned Court concerned but he
feels apprehension of his arrest at the hands of police, therefore, he needs
some protection to enable him to appear before the concerned Court.
Without touching the merits of the case, protective bail is granted to
applicant/accused above named, for a period of three (3) days from today, subject to his furnishing solvent surety
in the sum of Rs.25,000/- (Rupees twenty five thousand) and
P.R bond in the like amount to the satisfaction of the Nazir of this Court.
Applicant/accused is directed to surrender before the trial Court concerned in
the aforesaid period and join the investigation/trial forthwith. This order
shall cease to have its effect after expiry of three days from today or whenever
applicant surrenders before the trial Court concerned, which one occurs
earlier. It is made clear, in case, applicant/accused fails to surrender before
the trial Court in the aforesaid period, his bail bond shall stand
automatically forfeited.
The instant
criminal bail application is accordingly disposed
of.
