Muhammad Ameen son of Muhammad Aslam seeks post arrest bail in FIR No.189/2025,
registered at P.S. Gulistan-e-Johar, Karachi for offence under section 397,
448, 511, 34, PPC, after rejection of his bail plea by learned Additional
Sessions Judge-XII, Karachi East vide order dated 16.04.2025.
2. Facts
involved in the instant case are that on 18.03.2025 at 09:00 a.m. sister of
complainant informed him that some persons, male and female, after cutting
safety wires trying to enter the house, she asked him to reach early and report
the matter to police, when he reached the house of his sister, he saw that one
Alto car was standing there and some persons duly armed with weapons were
sitting in it. He knocked the door, his sister was yelling because she was made
hostage by accused persons. Due to hue and cry, mohalla people gathered, in the
meanwhile police also reached, they jumped over the wall. Present applicant and
2/3 females were available in house, who made his sister hostage. They were
apprehended, present applicant disclosed his name as Muhammad Ameen whereas
females succeeded to run away by taking advantage of rush. Hence the subject
FIR.
3. Learned
counsel for applicant submits that applicant is innocent and he has been
falsely implicated in this case; that there is no criminal record of applicant;
that he has no nexus with co-accused Abdul Lateef Chishti, who is a hardened
and desperate criminal, involved in so many criminal cases and there is
sufficient material available on record which requires further inquiry in terms
of section 497(2), Cr.PC.
3. On the
other hand, learned Additional Prosecutor General Sindh, assisted by
complainant, opposed for grant of bail on the ground that applicant was apprehended
at spot by complainant party with the help of people of vicinity, who gathered
at the spot and injured him. She further submits that applicant belongs to the gang
of Abdul Lateef Chishti group, who is a Qabza
Mafia.
4. Heard
learned counsel for applicant, Additional Prosecutor General Sindh, complainant
in person and perused the material available on record.
5. From
tentative assessment of material available on record it appears that applicant
was apprehended red handed at the spot by the complainant with the help of
mohalla people, who got him injured, he was produced before learned Magistrate,
such fact is confirmed by perusal of record. IO present in Court submits that
applicant belongs to a hardened and desperate criminal gang, which is involved
in Qabza, robbery and other criminal cases. Since the applicant was arrested at
the spot, which connects him with the commission of alleged offence. No case
for further inquiry in the guilt of applicant is made out. Therefore, instant
criminal bail application for post arrest bail is dismissed.
6. Needless
to mention here that observations made herein above are tentative in nature and
would not prejudice the case of either party at trial.
