Appellant Zain
son of Muhammad Aslam was tried by learned Additional
Sessions Judge-III, Karachi South, in Sessions Case No.1425/2020, arising out
of FIR No.126/2020, registered at P.S. Kalri, Karachi
for offence under Section 376, PPC. After full dressed trial, appellant was
convicted under section 376(i), PPC and sentenced to 10 years R.I. and to pay
fine Rs.100,000/-, in default whereof to undergo S.I
for 3 months days more. Benefit of section 382-B, Cr.PC
was extended to appellant. Hence the instant appeal.
Jail roll was called from Senior
Superintendent, Central Prison, Karachi, which reveals that the appellant has
served out his sentence, including sentence in lieu of fine and has been
released from jail on 11.01.2025. Thereafter, appellant has never approached
this Court to contest his appeal on merits, which shows that he is are not
interested to contest his appeal. Therefore, instant criminal appeal is
dismissed as having become infructuous.
