Applicant/complainant
seeks transfer of Sessions Case No.1488/2023, arising out of FIR No.134/2023,
registered at P.S. Ferozabad, for offence under
sections 147, 148, 149, 324, 34, PPC from the file of learned IV Additional
Sessions Judge Karachi East to any other competent Court of law.
Pursuant
to Court notice, respondents 1 and 5 appeared and submit that the remaining
respondents are their brothers and sister and they have recorded no objection
for transfer of aforesaid sessions case from the file
of learned IV Additional Sessions Judge Karachi East to any other competent
Court of law. Learned D.P.G. has also recorded no objection.
By
consent, instant transfer application is allowed and the aforesaid sessions case is transferred from the file of learned IV
Additional Sessions Judge Karachi East to learned Sessions Judge, Karachi East,
who may proceed with the case himself or assign the same to any other Court for
disposal in accordance with law. However, learned trial Court is directed to
conclude the trial preferably within a period of three months, without granting
adjournment to either party on any flimsy ground, under intimation to this
Court through learned MIT-II.
