Appellants
Ubaidullah Khan and Osama were tried by learned
Additional Sessions Judge-VI, Karachi East, in Sessions Case No.1373/2023,
arising out of FIR No.200 of 2023, registered at P.S. Awami
Colony, Karachi for offence under Sections 397, 34, PPC. After full dressed
trial, appellants were convicted under section 392, PPC and sentenced to 3
years R.I. and to pay fine Rs.5000/- each, in failure whereof to undergo R.I.
for 3 months more. Benefit of section 382-B, Cr.PC
was extended to appellants. Hence the instant appeal.
Today,
jail roll was called from Superintendent, District Prison and Correctional
Facility Malir, Karachi, which reveals that the
appellants have served out their sentence, including sentence in lieu of fine
and have been released from jail on 20.04.2024. Thereafter, appellants have
never approached this Court to contest their appeal on merits, which shows that
they are not interested to contest their appeal. Therefore, instant criminal appeal
is dismissed as having become infructuous.
