Along with urgent application, application
for return of surety is moved by applicant/surety. It appears that protective bail
was granted to applicant Sikandar Ali Chhajro by this Court vide order dated 28.02.2025, subject
to furnishing solvent surety in the sum of Rs.30,000/- each and P.R. bond in
the like amount to the satisfaction of the Nazir of this Court. As per
endorsement of Nazir, one Ali Raqza Chandio son of Ali Dost Chandio furnished
surety for applicant by way of depositing cash Rs.30,000/-.
Counsel for applicant/surety submits
that applicant surrendered before the trial Court concerned and admitted to
interim pre-arrest bail vide order dated 25.03.2025, however, the same was
recalled by learned Additional Sessions Judge-X, Karachi West vide order dated
16.04.2025. Certified copy of order dated 16.04.2025 is placed on record.
Learned Addl: Prosecutor General Sindh present in
Court in some other cases waives notice and after having gone through the case
file and order dated 16.04.2025 has recorded no objection for return of surety.
In the view of above, surety is no
more required. Application for return of surety is allowed. Office is directed
to return the surety to the applicant/surety upon proper verification and
identification, as per rules.
