Muhammad Waheed
son of Muhammad Hanif, through his mother Mst. Anwari Begum wife of
Muhammad Hanif (late) seeks protective bail in FIR
No.03/2020, registered at P.S. FIA, CCRC, Karachi for offence under Sections
13, 16, 20, 21, 24 of PECA read with section 109, 419, 500 PPC. Learned counsel
for applicant submits that applicant was unaware about registration of
aforesaid FIR and he has not intentionally absconded; that applicant is
innocent and has been falsely implicated in this case, at present he is at
Qatar and intends to travel from Qatar to Karachi by tomorrow; that he is a law
abiding citizen and intends to surrender before learned trial Court concerned
but he apprehends his arrest in the wake of NBW issued against him, as such he needs
some protection to enable to appear before the trial Court concerned.
Without touching the merits of the case, protective bail is granted to applicants/accused
above named for a period of five (5)
days from today, subject to furnishing solvent surety in the sum of Rs.25,000/- (Rupees twenty five thousand) each and P.R bond in the like amount to the satisfaction of the Nazir
of this Court. Applicant/accused is directed to surrender before the trial
Court concerned in the aforesaid period and join the trial forthwith. Operation
of NWB issued against the applicant/accused is suspended for five days. This
order shall cease to have its effect after expiry of five days from today or
whenever applicant surrenders before the trial Court concerned, which one
occurs earlier. It is made clear, in case, applicant fails to surrender before
the trial Court in the aforesaid period, his bail bond shall stands
automatically forfeited.
The instant
criminal bail application is accordingly disposed
of.
