Mst. Rukhsana Rashid and
Rashid seek pre-arrest bail in FIR No.576 of 2024, registered at P.S. Shahrah-e-Noor Jahan, Karachi for
offence under Sections 302, 34, PPC, after rejection of their bail plea by
learned Additional Sessions Judge-VII/MCTC-2, Karachi Central vide order dated
26.11.2024.
Learned
counsel for applicants/accused, at the very outset, submits that during
investigation applicants are found innocent and IO has placed their names in
Column-2 of challan, which has been accepted by
learned Magistrate concerned. He further submits that interim pre-arrest bail
granted to the applicants may be confirmed on the ground that complainant can
approach to next forum against acceptance of challan.
Learned Additional Prosecutor General Sindh has no recorded no objection. In
view of such position, interim pre-arrest bail granted to the applicants/accused
by this Court vide order dated 02.12.2024 is confirmed on the same terms and
conditions.
Instant
criminal bail application is disposed of in the above terms.
