Amir Abdullah Khan son of Abdullah Khan seeks pre-arrest bail in FIR
No.129/2025, registered at P.S. Docks for offence under Sections 354, 337-A(i), PPC, alleging therein that during scuffle he torn her
shirt due to which her body was exposed to public, after rejection of his bail
plea by learned Additional Sessions Judge-X, Karachi West vide order dated
06.03.2025.
2. Learned
counsel for applicant submits that sections applied in the FIR are bailable and the applicant has already furnished the
required surety. Even otherwise, alleged offence does not come within the ambit
of prohibitory clause of Section 497, Cr.PC; that
there is delay of more the three hours in lodging of FIR.
3. Learned
Additional Prosecutor General Sindh has recorded her objection for grant of
bail on the ground that IO has collected sufficient material against the
applicant to connect him with the alleged offence. IO present in Court submits
that she has not added any other section in the interim challan
submitted by her before learned concerned Judicial Magistrate.
4. Heard
learned counsel for applicant as well as Addl:
Prosecutor General Sindh and perused the material available on record.
5. Admittedly,
the alleged offence is bailable whereby he has to
furnish surety to the satisfaction of learned concerned Magistrate. IO present
in Court submits that she has not added other sections in the interim challan. In view of such position, interim pre-arrest bail
granted to applicant by this Court vide order dated 12.03.2025 is confirmed on
the same terms and conditions.
Instant criminal bail application is disposed of in the
above terms.
