Through this criminal misc. application, the learned counsel for the applicant has impugned the order dated 12.10.2024, wherein learned 1st Civil Judge and J.M/MTMC Jacobabad disposed of the case in "C" class observing that there is a civil dispute in between the parties and tried to convert the civil litigation into criminal litigation.
Per learned counsel, sufficient material was available against the accused persons but the Magistrate did not consider the same and disposed of the case in "C" class.
I have seen the record, which reflects that incident took place on 12.11.2022, whereas incident was reported on 09.07.2024 with delay of more than two years. No illegality or irregularity has been pointed out by the learned counsel for the applicant in the application. Resultantly instant criminal misc. application is dismissed along with listed application. However, the applicant is at liberty to file direct complaint before the competent court of law having jurisdiction, if he chooses so.
Instant criminal misc. application stands disposed of as above.
