None present for the appellant, no intimation is received. Same was the position on the last date of hearing, which shows that applicant has no interest to purse this case. Mr. Abid Hussain Qadri, advocate holding brief for Mr. Ahsan Ali Qureshi, advocate for the appellant states that latter is out of station.

I have perused the record, which reflects that on the last date of hearing the appellant and his counsel was called absent, no intimation was received. This matter pertains to the year 2022, since then no progress has been made. After registration of F.I.R, the case was proceeded and eye witness, namely, Abdul Hakeem deposed before the court that P.Ws were not present at the place of incident and the accused was not available at the place of incident. On the basis of the statement of P.Ws/eye witnesses, the respondents/accused were acquitted.

In view of above, no illegality or irregularity has been pointed out by the learned counsel for the appellant, resultantly, instant criminal acquittal appeal is dismissed.
