            Applicant/accused Muhammad Zubair Feroz present

            Applicant/accused Muhammad Zubair Feroz son of Feroz Khan seeks        pre-arrest bail in FIR No.204/2025, registered at P.S. Ferozabad, for offence under Section 489-F, PPC after dismissal of his bail plea by the trial Court vide order dated 19.03.2025.

 

Perusal of order dated 19.03.2025 reveals that bail application of applicant/accused was dismissed for non-prosecution due to his absence. Applicant submits that on the date of hearing when his bail application was dismissed for    non-prosecution he was suffering from serious ailment, therefore, he could not appear before learned trial Court.

 

In the interest of justice, this pre-arrest bail application is converted into application for protective bail and the applicant is admitted to protective bail for a period of five (5) days from today, subject to furnishing solvent surety in the sum of Rs.25,000/- (Rupees twenty five thousand) and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Applicant/accused is directed to surrender before the learned concerned Court in the aforesaid period as to get decision on merits and join the trial forthwith. This order shall cease to have its effect after expiry of five days from today or whenever applicant surrenders before the trial Court, which one occurs earlier. It is made clear, in case, applicant/accused fails to surrender before the trial Court in the aforesaid period, his bail bond shall stands automatically forfeited.

 

            The instant criminal bail application is accordingly disposed of.
