Abdul Razzaque
son of Lal Bux seeks protective
bail in FIR No.04/2022, registered at P.S. ACE Kandhkot
for offence under section 161, 409, PPC read with section 5(2) of the PCA-II of
1947. Learned counsel for applicant submits that applicant is innocent and has
been falsely implicated in this case in order to humiliate and disgrace him; that
applicant was unaware about registration of instant case against him and now he
came to know about pendency of this case; that he is a law abiding citizen and intends
to surrender before the concerned Court but he feels apprehension of his arrest
at the hands of ACE Officials in the wake of NBW issued against, hence he needs
some protection to enable him to appear before the Court concerned.
Without touching the merits of the case, protective bail is granted to
applicant/accused above named, for a period of five (5) days from today, subject to furnishing solvent surety in
the sum of Rs.15,000/- (Rupees fifteen thousand) and P.R
bond in the like amount to the satisfaction of the Nazir of this Court. Operation
of NBW issued against the applicant/accused is suspended for five days. Applicant
is directed to surrender before the trial Court concerned in the aforesaid
period and join the trial forthwith. This order shall cease to have its effect
after expiry of five days from today or whenever applicant surrenders before
the trial Court, which one occurs earlier. It is made clear, in case, applicant
fails to surrender before the trial Court in the aforesaid period, his bail
bond shall stand automatically forfeited.
The
instant criminal bail application is accordingly disposed of.
