Petitioner
is father of alleged detainee Mst. Najma and has filed this petition for direction to the
official respondents to recover his daughter Mst. Najma and produce her before this Court. It has come on
record that Mst. Najma
filed C.P. No.D-1243/2025,
whereby she has taken the stance that she has contracted marriage with Lutuf Ali, who is accused in FIR No.31/2025, registered at
P.S. Gharo, District Thatta,
under Sections 3, 4 and 5 of the Child Marriage Restraint Act, 2013 for
protection and quashment of FIR. This Court passed
order dated 09.04.2025 whereby petition was disposed of with direction to the
petitioners to appear before learned trial Court in view of the dictum laid
down in the case of Director General, Anti-Correction Establishment Lahore vs.
Muhammad Akram Khan (PLD 2013 SC 401). Since it has
come on record that she appeared in Court and filed petition against her father
and others, therefore, no case for issuance of writ of habeas corpus has been
made out, as such, instant petition is dismissed
along with pending application(s), if any.
