            Applicant/accused Ameer Ali son of Muhammad Yaqoob seeks protective bail in FIR No.439/2023, registered at Collectorate of Customs Enforcement, Anti-Smuggling Organization Headquarters, N.M.B. Wharf, Karachi for offence under sections 2(s), 15, 16, 17, 157(2), 178, 187 of the Customs Act, 1969. Learned counsel for applicant submits that applicant is innocent and he has been falsely implicated in this case due to mala intentions and ulterior motives; that applicant is a law abiding citizen and intends to surrender before the trial Court/Special Judge, CNS-II, Karachi but he apprehends his arrest at the hands of concerned police in the wake of NBW issued against him by the trial Court.

 

Without touching the merits of the case, protective bail is granted to applicant/accused above named, for a period of three (3) days from today, subject to furnishing solvent surety in the sum of Rs.25,000/- (Rupees twenty five thousand) and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Operation of NBW issued against the applicant is suspended for three days. Applicant is directed to surrender before the trial Court concerned in the aforesaid period and join the trial forthwith. This order shall cease to have its effect after expiry of three days from today or whenever the applicant surrenders before the trial Court, which one occurs earlier. It is made clear, in case, applicant fails to surrender before the trial Court in the aforesaid period, his bail bond shall stand automatically forfeited.

 

            The instant criminal bail application is accordingly disposed of.
